Keep in Mind High Heels Can Affect Your Ability to Perform a Sobriety Test

Wanting to look your best when going out for the night is normal, but high heels and feet or ankles that aren’t used to walking in these shoes could lead to an arrest. It sounds strange, but until you understand why, it’s probably best to wear low heels or flats if you are going out for the night with friends.

Wiggle, Wobble, Walk to Jail

Heels may look nice, but even fashion models wiggle and wobble when they walk in these shoes. They are designed to create a certain feminine profile, but they can be problematic when a police officer wants you to walk heel to toe. This particular aspect of a sobriety test can cause you to wobble more and even fall down when the pointed toes of these shoes hit or trip the heel of the shoe in front.

The Police Arrest Based on What They Observe

When your high heels cause you to stumble and fall, what the police see is someone who’s had too much to drink. You could be completely sober, but they will claim that they see an intoxicated person. A false arrest ensues, and your heels just landed you in a lot of trouble.

Luckily, You May Get This Case Thrown Out

If it was your heels and not intoxication, a good lawyer can help get your case thrown out. However, if the police also performed a blood test and found alcohol in your system, it might be a little trickier. Proving that your heels alone are the cause of your arrest is possible, but not if you had other tests done that proved you were under the influence.

What to Do Next If Your High Heels Got You Arrested

Ask for a lawyer and don’t do any other sobriety tests. Going forward, don’t wear heels when going out on the town to prevent any future sobriety test failures. Follow your lawyer’s further instructions to get out of this strange, sticky situation.
