How to Fight a Property Lien

Getting slapped with a property lien is no one’s idea of a good time. However, it isn’t the argument ender that some people perceive it to be. There are certain steps that you can take to break the impasse that a lien creates. Doing so may help you to resolve the matter to your ultimate satisfaction.

Pay It Off and Get a Lien Release

Paying the lien off in full may not be your preferred way to handle the matter. However, it is almost always the quickest and easiest way to get the burden off your shoulders.

If you have the money to do it, you may as well get it over with. Ask your creditor to give you a lien release form. File it with the county recorder’s office. In most cases, this will quickly clear the title to the property.

Ask the Court to Render It Null

If you believe that the lien is bogus or unjustified, you can ask a court to remove it. The best way to do so will be to file a lawsuit against your creditor. You will be required to give evidence to prove your claim that the lien should be removed.

Obtain a Lien Bond

A lien bond guarantees the payment of the debt to the creditor. This will be insurance in case you lose the lawsuit. Posting this type of bond will allow you to discharge the lien from your property. You can then transfer it straight to the bond.

Doing so will allow you to clear the title of your property. After doing so, you will be able to sell or refinance it. You can legally do so without having to pay off the debt in advance.
